Lawsuit: Big Rig Truck Wreck Left Child With Life-Long Disfigurement
The mother of a six-year-old child who was injured and faces life-long disfigurement hit Swift Transportation with a lawsuitalleging the company failed to exercise reasonable care in operating the truck that jackknifed and killed two others in the incident.
The catastrophic personal injury lawsuit alleges that a Swift Transportation big rig truck drifted across lanes of traffic and stopped in a jackknife position on State Route 124 in La Mesa, California.
According to California Highway Patrol officials, the semi-truck was entering southbound lanes on the highway on an August afternoon when the driver lost control and went through the guardrail and crossed into oncoming traffic. Two women were killed and six others injured, including the six-year-old who had a broken neck and wasn’t breathing when first responders arrived, reported NBC 7 San Diego.
The mother of the injured six-year-old alleges that the Swift Transportation driver is responsible for the big rig truck accident and her child’s injuries.
“The defendants’ negligent acts proximately caused Plaintiffs’ devastating injuries, including pain and suffering, financial loss, disfigurement, loss of enjoyment of life, and emotional distress,” alleges the catastrophic personal injury lawsuit.
Catastrophic Personal Injury: Disfigurement
When someone is injured because of the negligence or recklessness of others, a host of personal injuries can affect that person for life, including disfigurement.
Disfigurement can have a particularly long-lasting effect because it can impact a person’s physical abilities as well as their emotional wellbeing. Disfigurement may also require life-long medical treatment, taking a financial toll as well.

If an accident caused by the negligence or recklessness of others has disfigured an individual, that individual can claim monetary relief for the physical, emotional and financial damages caused by the accident. Compensation for disfigurement depends on a number of factors, including;
- The part of the body that has been affected by the disfigurement; for example, significant facial scarring;
- If an individual’s daily routine and abilities are affected by the disfigurement; for example, if an individual is unable to drive or do their job;
- If the disfigurement will cause embarrassment; and
- If it will require additional medical treatment or life-long treatment.
If you or a loved one have been in an accident, you should keep in mind that disfigurement can be as damaging in the long-run as other catastrophic personal injuries. Disfigurement can also lead to depression and even post-traumatic stress disorder, requiring mental health services. A person’s overall well-being and quality of life can be affected by disfigurement as well.
Those who have been disfigured because of the actions of others may want to consider contacting an experienced California personal injury attorney to ensure they receive appropriate compensation for their injuries.
